Quick Hitter Basketball Terms of Service
Last Updated: October 1, 2026
These Terms of Service ("Terms") govern your access to and use of the Quick Hitter Basketball mobile application and related services (collectively, the "Service"), operated by Quick Hitter HQ LLC, a Massachusetts limited liability company ("Quick Hitter," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account or use the Service. Quick Hitter Basketball is designed for basketball coaches and other authorized adult users and is not directed to children. By creating an account, you represent and warrant that you are at least 18 years old and are using the Service for a legitimate coaching, athletic, educational, or related purpose.
You may not create an account for a minor or permit a minor to use your account. Minors may not create accounts, join teams, receive invitations, or send or receive messages through the Service.
2. Description of the Service
Quick Hitter Basketball provides tools for basketball coaches, including an AI-assisted play generator, a manual play-drawing tool, social or feed features for sharing plays and video clips, personal storage or locker features, practice-planning and scouting-report tools, coaching-staff team accounts, direct and group messaging between authorized users, and related features that may be added, modified, suspended, or removed over time.
We may modify, suspend, or discontinue any portion of the Service, subject to applicable law and any obligations relating to paid subscriptions.
3. Accounts
You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring under your account. You agree to provide accurate information and keep it current. You may not share your account, impersonate another person, or create an account on another person's behalf without authorization. You must promptly notify us if you believe your account has been compromised.
4. User Content
4.1 Ownership. You retain ownership of videos, images, voice recordings, drawn plays, descriptions, comments, messages, and other content you upload, post, transmit, or create through the Service ("User Content"). Quick Hitter does not claim ownership of your User Content.
4.2 License to Quick Hitter. By submitting User Content, you grant Quick Hitter a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, transmit, format, and adapt that User Content solely as reasonably necessary to operate, provide, secure, and improve the Service and to provide the sharing features you select. This license ends when the applicable User Content or your account is deleted, except to the extent the content was previously shared with, saved by, or copied by another user in the ordinary operation of the Service, or retention is reasonably necessary for legal, security, fraud-prevention, backup, or compliance purposes.
4.3 Your Responsibilities and Representations. You are solely responsible for your User Content. By submitting User Content, you represent and warrant that you own it or have all rights, licenses, releases, consents, and permissions necessary to submit it and grant the license above; that it does not infringe or violate any copyright, trademark, privacy, publicity, contractual, or other right; and that it complies with applicable law and these Terms.
If User Content includes music, audio, video, photographs, or other third-party material, you are responsible for obtaining all necessary rights. A license to use material on another platform, including music available through a social-media platform, does not necessarily authorize its use on Quick Hitter Basketball.
4.4 Minors and Athlete Footage. If User Content depicts or identifies a minor, including youth or high-school athletes, you represent and warrant that you have obtained all permissions, releases, consents, and institutional or governing-body approvals required by applicable law, school policy, league rules, or other applicable requirements before uploading or sharing that content. Quick Hitter does not obtain those permissions on your behalf.
4.5 Prohibited Content and Conduct. You may not use the Service to upload, post, transmit, or facilitate content or conduct that is unlawful, defamatory, harassing, abusive, fraudulent, infringing, invasive of privacy or publicity rights, malicious, deceptive, or intended to disrupt the Service; impersonates another person or entity; or exploits, endangers, sexualizes, solicits, or otherwise harms minors. We may remove content and suspend or terminate accounts that violate these Terms, subject to applicable law.
4.6 Zero Tolerance; Reporting and Blocking. Quick Hitter has zero tolerance for objectionable content and abusive users. Users can report content and other users, and block users, directly in the Service. We review reports and aim to act within 24 hours, which may include removing content and suspending or terminating the responsible account.
5. AI-Generated Content
The Service includes an AI-assisted play generator that produces suggested basketball plays, diagrams, or related content based on user input. AI-generated content may be incomplete, inaccurate, duplicative, impractical, or unsuitable for a particular team, athlete, opponent, or situation. Quick Hitter does not guarantee that AI-generated content is strategically sound, original, error-free, or appropriate for any particular use.
You are responsible for evaluating AI-generated content and exercising your own coaching judgment before using it in practice or competition. AI-generated content is not medical, health, safety, legal, or other professional advice and is not a substitute for appropriate supervision, training, safety practices, or professional judgment.
6. Copyright / DMCA Policy
We respect the intellectual property rights of others and expect users to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and will terminate repeat infringers in appropriate circumstances.

A copyright notice should identify the copyrighted work claimed to be infringed; identify the allegedly infringing material and its location on the Service; provide the complaining party's contact information; include a good-faith statement that the disputed use is not authorized; include a statement, under penalty of perjury, that the notice is accurate and the complaining party is authorized to act for the copyright owner; and contain a physical or electronic signature.
7. Subscriptions and Payments
7.1 Plans. The Service offers a free tier with usage limits and paid subscription tiers with expanded features. Paid subscriptions are currently available only as in-app purchases through the Apple App Store. Pro subscriptions are offered on a monthly or annual basis. Staff subscriptions, which provide access for a coaching staff of two to five coaches, are offered on an annual basis. Current pricing and the features of each tier are displayed in the Service before purchase.
7.2 Automatic Renewal. All paid subscriptions automatically renew at the end of each subscription period (monthly or annual, as applicable) at the then-current price unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.
7.3 Billing and Cancellation. Payment is charged to your Apple ID account at confirmation of purchase. Apple handles all billing and payment processing, and your purchase is also subject to Apple’s applicable terms. You may manage or cancel your subscription in your Apple ID account subscription settings; to avoid renewal, cancel at least 24 hours before the end of the current period. Cancellation takes effect at the end of the current subscription period, and you will keep access to paid features until then. Deleting your Quick Hitter account does not cancel an App Store subscription.
7.4 Refunds. Refunds are handled by Apple under its policies and applicable law. Quick Hitter does not process payments and cannot issue refunds directly for App Store purchases.
7.5 Changes. We may change pricing or free-tier limits prospectively, with notice where required by law or Apple’s policies. Price changes to existing subscriptions will be handled through Apple’s price-change process.
8. Third-Party Services, Content, and Links
The Service may integrate with or permit links to third-party platforms, services, or content. Third-party services are governed by their own terms and privacy practices. Linking to or importing third-party content does not transfer ownership or other rights in that content to you or Quick Hitter. To the extent permitted by law, Quick Hitter is not responsible for the accuracy, legality, availability, security, or practices of unaffiliated third-party services.
9. Termination
You may stop using the Service and may delete your account as provided through the Service. We may suspend or terminate access for violation of these Terms, unlawful or harmful conduct, security reasons, or other legitimate reasons. Where practicable and appropriate, we may provide notice; however, immediate action may be taken when reasonably necessary to protect users, the Service, Quick Hitter, or third parties.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." QUICK HITTER DISCLAIMS WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY AI-GENERATED CONTENT WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
Nothing in these Terms excludes any warranty, right, or remedy that cannot lawfully be excluded.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUICK HITTER HQ LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICK HITTER'S AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID QUICK HITTER FOR THE SERVICE DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) $50.
These limitations apply only to the extent permitted by applicable law and do not limit liability that cannot legally be limited or excluded.
12. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Quick Hitter HQ LLC and its members, managers, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable attorneys' fees arising out of or relating to your User Content; your violation of these Terms or applicable law; your infringement or violation of another person's intellectual property, privacy, publicity, or other rights; or your failure to obtain required consent or authorization for athlete or minor-related content.
13. Governing Law and Forum
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles. Subject to any rights that cannot lawfully be waived, any judicial proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state courts located in Plymouth County, Massachusetts, or the United States District Court for the District of Massachusetts, and you consent to personal jurisdiction there.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means as required by applicable law. The revised Terms will state their effective date. Continued use of the Service after the revised Terms take effect constitutes acceptance to the extent permitted by law.
